Biodiversity Net Gain (BNG) Regulations in England

Biodiversity Net Gain (BNG) is a mandatory requirement for most new developments in England, ensuring that the natural environment is measurably improved after development. The policy, introduced under the Environment Act 2021, aims to balance development with ecological restoration and long-term sustainability

What is Biodiversity Net Gain?

BNG requires developers to deliver at least a 10% improvement in biodiversity value compared to the pre-development state. This is measured using the government’s statutory biodiversity metric, which evaluates habitat size, type, quality, and location

Who Must Comply?

BNG applies to:

How is BNG Achieved?

Developers must follow the biodiversity gain hierarchy:

All new or improved habitats must be maintained for at least 30 years

The BNG Process

Baseline Assessment:

A biodiversity survey is conducted before development to calculate the site’s baseline biodiversity value using the statutory metric.

Biodiversity Gain Plan:

Developers must submit a Biodiversity Gain Plan to the local planning authority, detailing how the 10% net gain will be achieved and maintained. The plan must be approved before development begins

Delivery and Maintenance:

Registration:

Off-site biodiversity gains must be registered on the national Biodiversity Gain Site Register

Special Considerations

Irreplaceable Habitats:

Special rules apply for habitats such as ancient woodland.

Strategic Significance:

The location and type of habitat can affect the number of biodiversity units awarded.

Spatial Risk Multiplier:

Off-site units further from the development site may be subject to a multiplier, reducing their value.

Ongoing Policy Development

BNG regulations are evolving, with current government consultations focused on refining requirements for minor, medium, and brownfield developments, as well as nationally significant infrastructure projects.
